TOWN OF LAYTONSVILLE
ORDINANCE ADOPTING ROAD CONSTRUCTION
CODE
OF MONTGOMERY COUNTY, MARYLAND
BE IT
HEREBY RESOLVED, BY THE Mayor And Council of the Town of Laytonsville that:
- The
Mayor and Council hereby adopt Art. II entitled “Road Construction Code”
of Chapter 49 of the 1984 Montgomery County Code.
- From
and after the effective date of this Ordinance, no person shall grade,
install, cut, construct, or re-construct any surface material, subsurface
material, paving, drainage structure, curb, gutter, sidewalk, driveway
entrance, retaining wall, step, or any other structure within the
right-of-way of any public street, road, highway, avenue, lane, alley,
viaduct, or public way in the Town unless said person shall first obtain a
permit from Montgomery County, Maryland, and comply with all applicable
provisions of Art. II of Chapter 49 of the 1984 Montgomery County Code, as
though said right-of-way were located within the unincorporated area of
Montgomery County, Maryland.
- Upon
completion of such construction in compliance with the County’s Road
Construction Code, and notification thereof to the Town, the road,
sidewalk, or whatever work was performed in the right-of-way shall be
deemed to be accepted for maintenance by the Town from and after the date
that the same would be deemed accepted for maintenance by the County as if
the work had been performed in an unincorporated area of the County.
- This
Ordinance shall take effect upon its adoption and shall apply to all
applications for permits filed thereafter. The Town’s Road Code in effect prior to the adoption of this
Ordinance shall remain in force and effect as to all work in progress
under permits granted prior to the adoption of this Ordinance.
- The
Road Code adopted by the Town of Laytonsville on January 17, 1969 and all
amendments thereto, are hereby repealed except as otherwise provided in
Paragraph 4 above.
