ORDINANCE TO GRANT TO THE TOWN THE POWER TO ACQUIRE

                  BY GIFT, DEVISE, PURCHASE, OR CONDEMNATION REAL OR

                 PERSONAL PROPERTY NEEDED FOR ANY PUBLIC PURPOSE,

                                                 AND TO DISPOSE OF SAME

 

 

The authority to adopt this Ordinance is set forth in subsection 2(b) (24) of Article 23A of the Annotated Code of Maryland.  The Ordinance is follows:

 

The Mayor and Council of Laytonsville shall have the following powers and authority:

 

  1.  To acquire real or personal property within or without the corporate limits of the Town for any public purpose, by purchase, gift, devise, condemnation, or otherwise, and to sell, lease, or otherwise dispose of any property belonging to the Town.

 

  2.  To condemn property of any kind or any interest therein, in fee or as an easement, within or without the corporate limits of the Town, for any public purpose.  Any activity, project, or improvement authorized by the provisions of this Ordinance or any State or local law shall be deemed to be a public purpose.

 

  3.  Any and all condemnation proceedings undertaken by the Mayor and Council in exercise of the above procedure shall be conducted in accordance with the Annotated Code of Maryland and the Maryland Rules of Procedure.
