Laytonsville Historic District Commission Meeting Minutes-March 21,2005

The regular meeting of the Laytonsville Historic District Commission (HDC) was called to order by Chair Sheree Wenger at 7:30 p.m. Commission members Howes, Ruspi, Sterling, and Techter were present.

Mr. Techter made a motion to approve the minutes of the February 21, 2005 minutes. Second by Ms. Ruspi. Motion approved.

The Chair opened the hearing for Historic District Work Permit (HDWP) 01-04, property located at 7115 Brink Rd. The applicant is requesting an extension of time for completion of construction. An HDWP requires all work be completed within one year from date of approval. The original application has reached its one year expiration date.

Ms. Ruspi recused herself from the review of this application by the HDC.

The applicant submitted a letter requesting an extension and provided a new set of plans.

Comments of Applicant:

Ms. Sidra Berman, Applicant Discussed the necessity to apply for new construction permits from Montgomery County due to structural problems of original home. All permits have been issued and project is ready to resume. There is a plan to dismantle existing structure, in order to dig basement, and re-build structure. There are no planned exterior changes to original plans.

Public Comment:

Jim and Jill Ruspi, 7111 Brink Rd. Ms. Ruspi read a prepared letter expressing concerns about the project. They requested the following conditions become part of any extension granted by the HDC:

1.  A maximum extension of 6 months

2.   The property should be secured and made safe

3.   The property should be cleared of debris and grounds maintained

4.   The grounds of the property should have regular maintenance, to include cutting lawn and trimming weeds.

Rebuttal by Applicant

Ms. Berman Stated her desire to maintain the property and conclude the project as expeditiously as possible.

There being no other discussion the Chair closed the record and called for the motion. Mr. Techter moved to approve the extension of one year, based on the evidence presented and subject to items 2,3, and 4, as referenced in the letter of Mr. and Ms. Ruspi. The approval would also be subject to a six month review by the HDC. Second by Ms. Howes. Motion unanimously approved.


New Business

Ms. Wenger reported that property owner of 21516 Laytonsville Rd had notified her of their intent to replace the roof. This work is regarded as routine maintenance and therefore does not require a permit.

The Chair opened discussion of a recommendation to include St. Paul United Methodist Church and Cemetery to the historic district. The historic significance of these entities is well documented and it is believed designation would maintain their integrity and provide continuity to the overall district. A formal recommendation for this designation could be made in the forthcoming Comprehensive Plan for the Town. Mr. Techter made a motion to recommend historic designation of St Paul United Methodist Church and Cemetery. Second by Ms. Howes. Motion approved.

Ms. Sterling suggested the HOC make further recommendations of its goals to the Comprehensive Plan. The identification of properties in the historic district as contributing or non-contributing resources was discussed. The HOC would establish a criteria for each designation. Chair Wenger will contact the Maryland Historical Trust for further guidance.

Old Business

Commission members briefly discussed new construction in the historic district.
