Meeting minutes of Town Council on January 5, 2010
As reviewed, approved, and accepted by the Town Council on February 2, 2010
Mayor Oland called the regular Town Council meeting to order at 7:34p.m. Council Members Jim Ruspi, David Preusch, Charles Bradsher and Dan Prats were present. The Clerk and the Assistant Treasurer were present. There were two citizens present.
The minutes of the regular Town Council Meeting on December 1, 2009 were approved as submitted.
Treasurer’s Report: Assistant Treasurer Brad Taulbee reviewed the Profit and Loss Report for the month of December, 2009: total income for the month of December was $3,236.00. Property taxes in the amount of $2,940.00 was received. Major expenses for December, 2009 were $2,886.00 for Waste Collection; Payroll in the amount of $2,664.00; Accounting in the amount of $4,002.00; and Snow Removal in the amount of $2,778.00 Total net income for the month of December, 2009 was -$12,432.00. Looking at the Balance Sheet for the month of December, 2009, the fund balance for the general fund is $380,171.00; for the CIP account, the balance is $108,351.00; and the balance for the fixed assets fund is $493,938.00. The total fund balance for the Town of Laytonsville for the month of December, 2009 is $982,460.00
Council Member Dan Prats made the motion to approve the Treasurer’s Report for the month of December, 2009 subject to audit. Council Member Charles Bradsher seconded. Unanimously approved.
Discussion/Action:
Rules for Public Information Act Requests: Mayor Oland noted that the Rules of the Town of Laytonsville, Maryland for Public Information Act Requests document drafted by Town Counsel, Stanley Abrams was distributed at the December 1, 2009 Town Council for review. Council Member Dan Prats noted that the document was consistent with the Public Information Act Attorney’s General Office and also noted that Section .11 Review of the Denial allowed the applicant to request a hearing (if a written request is denied) and the hearing shall be conducted by the Mayor and Council.
Laytonsville Elementary School – Safety Conditions: Mayor Oland noted that the usual quick response from the State Highway Administration was not forthcoming in his repeated requests to them regarding the safety conditions at the Laytonsville Elementary School. Kris Bradsher has written a letter to Senator Rona Kramer regarding these conditions. Mayor Oland referred this project to Council Member Charles Bradsher for follow-up.
Speed Camera: Mayor Oland noted that the Town had received notification from Montgomery County regarding the Town’s interest in the installation of a speed camera on Route 108. Due to the Town’s commercial activity, Montgomery County denied the request. The request may be reconsidered at this time. The Mayor and Council will re-visit this issue in February.
Introduce Forest Conservation Amendment Ordinance: Mayor Oland noted that a draft Ordinance had been prepared by the Town Counsel, Stanley Abrams, and distributed for review. The purpose of the draft Ordinance was to conform to current State law. The hearing to consider this draft Ordinance will be February 2, 2010.
Goshen Mennonite Church: The students will be at the Town Hall for their community service project on 1-16-10. All are invited to attend their musical session at the conclusion of their service project.
FIOS: Mayor Oland noted that the Town of Laytonsville is considered an “extended area” and that service is projected for the second half of 2010; service to all residences within the Extended Service Area by November 28, 2013.
2009 Picnic DVD: the DVD is available by contacting the Town Hall. Price is $5.00.
Work Session: The work Session for January 19, 2010 has been cancelled.
Action:
Rules for Public Information Act Requests: Council Member Jim Ruspi made the motion to approve the Rules for Public Information Act Requests. Council Member Dan Prats seconded. Unanimously approved.
Council: Council Member Jim Ruspi commented on the sidewalk snow removal from the storm on December 19 and that he thought the sidewalks were cleared as quickly as possible.
