Meeting minutes of Town Council on August 4, 2009        

As reviewed, approved, and accepted by the Town Council on September 1, 2009

 

Mayor Oland called the regular Town Council meeting to order at 7:35 p.m.    Council Members Jim Ruspi, David Preusch, Charles Bradsher and Dan Prats were present.     The Clerk was present.  There were thirteen citizens present. 

Mayor Oland welcomed Council Member Charles Bradsher back to the Council from his third tour in the Middle East.  The Council temporarily appointed Kris Bradsher as his replacement during his deployment.

The minutes of the regular Town Council Meeting on July 7, 2009 were approved as submitted.  The minutes of the Public Hearing on July 7, 2009 were approved as submitted.

Treasurer’s Report:    Mayor Oland reviewed the Profit and Loss Report for the month of July, 2009: total income for the month of July was $9,342.00.  Licenses in the amount of $8,727.00 were received.   Major expenses for July, 2009 were $2,734.00 for Waste Collection;  Grounds maintenance in the amount of $2,525.00; Repairs & Maintenance in the amount of $2,885.00; Legal in the amount of $7,144.00 and Insurance in the amount of $2,351.00.  Total net income for the month of July, 2009 was -$16,016.00.  Looking at the Balance Sheet for the month of July, 2009, the fund balance for the general fund is $334,790.00; for the CIP account, the balance is $104,772.00; and the balance for the fixed assets fund is $493,938.00.  The total fund balance for the Town of Laytonsville for the month of July, 2009 is $933,500.00 

Council Member David Preusch made the motion to approve the Treasurer’s Report for the month of July, 2009 subject to audit.  Council Member Dan Prats seconded.  Unanimously approved.

Designation of Certain Properties, Resources and Environmental Settings – Lots 5, 6 and 12:  Mayor Oland noted that at the June 2, 2009 regular Town Council meeting, the motion to have the Historic District Commission review these lots that impact the historic Rolling Ridge house was tabled.  The tabled motion was discussed at the July 7, 2009 regular Town Council meeting.  In Robert’s Rules of Order, a tabled motion is not debatable, cannot be amended and the motion, therefore, is still on the table. 

 

Council Member Jim Ruspi made the motion to withdraw the motion made at the June 2, 2009 regular Town Council meeting motion to have the Historic District Commission review Lots 5, 6 and 12 that impact the historic Rolling Ridge house.  Mayor Oland seconded.  Unanimously approved.

Council Member Jim Ruspi made the motion to close the record of the Public Hearing held on July 7, 2009 to consider the designation of certain properties, resources and environmental settings has having or protecting resources of historic or architectural significance consistent with the general welfare of the Town, its inhabitants and visitors and to further consider designation of the following sites, resources and environmental settings as having historic or architectural significance subject to the provisions of Section 127 of the Town’s Zoning Ordinance:  Lots 5, 6 and 12, Block “A” of the Rolling Ridge Subdivision adjacent to Rolling Ridge Lane in the Town of Laytonsville.  Council Member David Preusch seconded.  Unanimously approved.

Mayor Oland made the motion to not go forward with the Draft Resolution designating Lots 5, 6 and 12, Block “A” of the Rolling Ridge subdivision and abutting portions of Rolling Ridge Lane as historic resources in the Town of Laytonsville.  Council Member David Preusch seconded.  Unanimously approved.

Proposed Resolution – Mayor and Council take into Consideration the Recommendations of the Historic District Commission when approving permits submitted for Lots 5, 6 and 12 – Rolling Ridge Subdivision:   Mayor Oland introduced a proposed Resolution to take into consideration the recommendations of the Historic District Commission prior to approving permits (building and other) submitted for Lots 5, 6 and 12 in the Rolling Ridge subdivision.  These permit applications will come in for consideration after approval by the Rolling Ridge Homeowners Association.  Council Member Jim Ruspi requested that the language in the last paragraph of the draft read “Historic District Commission prior to approving permits . . . .” and not “when approving permits . . .”.

Mayor Oland requested comments.  Mr. Azeem (Lot 12, Rolling Ridge subdivision) inquired as to the process if the Rolling Ridge HOA approves a permit.  Mayor Oland responded that the Mayor and/or Town Council will look to the Historic District Commission for their recommendation.  If declined, the decision can be appealed.

Mrs. Phyllis Sterling would like to suggest that the Historic District Commission add to the Guidelines the language that documentation should be provided from the HOA in the approval/declination process.

Appoint Historic District Commission Member – Charles Hendricks:  Mayor Oland noted that when Dan Prats resigned from the HDC, Charles Hendricks, alternate, assumed the position of regular HDC member.

 

 

Town Hall Roof:  Mayor Oland noted that the original proposal of $8,500.00 from Carlos Mosquera Painting, Inc. was still viable. His company is prepared to go forward with the Town Hall roof.   The North/South sides of the Town Hall have been painted.

Town Picnic – September 19, 2009:  The Town picnic will be held on September 19, 2009, 5:00 – 9:00 p.m.  Food is available by ticket.

Washington Suburban Sanitary Commission Update:  Mayor Oland noted that the meeting scheduled for August 3 was cancelled by WSSC.

Maryland Department of the Environment – Free Septic Upgrade:  Residents can contact Maryland department of the Environment at 410.537.4195 or www.mde.state.md.us/water/CBWRF/osds_preapp.asp to learn about free septic upgrades.

Work Session – August 18, 2009:  The Work Session has been cancelled.

 

Action: 

Appoint Historic District Commission Member – Charles Hendricks:  Council Member Dan Prats made the motion to appoint Charles Hendricks as a full member of the Historic District Commission.  Council Member Kris Bradsher seconded.  Unanimously approved.

Proposed Resolution – Mayor and Council take into Consideration the Recommendations of the Historic District Commission when approving permits submitted for Lots 5, 6 and 12 – Rolling Ridge Subdivision:   Council Member Jim Ruspi made the motion to take into consideration the recommendations of the Historic District Commission when approving permits submitted for Lots 5, 6, and 12.  Council Member Dan Prats seconded.  Unanimously approved.

Town Hall Roof:  Council Member Jim Ruspi made the motion to approve Carlos Mosquera Painting, Inc.’s proposal of $8,500.00 to repaint the Town Hall roof.  Council Member David Preusch seconded.  Unanimously approved.

Council:

Council Member Jim Ruspi questioned the solid waste by the outbuildings at 6835 Laytonsville Road and what could be done.

 

 

 

 

 

Citizens:

Mrs. Sheree Wenger, Chair of the Historic District Commission, reported that vandalism had occurred on Lot 1, Rolling Ridge subdivision and perhaps at the Laytonsville Elementary School.

Mrs. Phyllis Sterling introduced Rev. Jim Pugh, the new pastor at St. Paul United Methodist Church.

Council Member David Preusch made the motion to adjourn the regular meeting at 8:15 p.m.  Council Member Dan Prats seconded.  Unanimously approved.
