Meeting minutes of Town Council on March 3, 2009        

As reviewed, approved, and accepted by the Town Council on April 7, 2009

 

Mayor Oland called the regular Town Council meeting to order at 7:40 p.m.    Council Members, Frank Bennett, David Preusch and Kris Bradsher were present.  Council Member-Elect James Ruspi was absent   The Clerk and the Assistant Treasurer were present.  There were seven citizens present.

The minutes of the regular Town Council Meeting on February 3, 2009 were approved as submitted.   The minutes of the Public Hearing to consider Amendments to Zoning Ordinance Section 104 and 110 on February 3, 2009 were approved as submitted.

Treasurer’s Report:    The Assistant Treasurer reviewed the Profit and Loss Report for the month of February, 2009: total income for the month of February was $1,594.00. Property tax in the amount of $603.00 was received.  Major expenses for February, 2009 were $2,734.00 for Waste Collection; Advertising in the amount of $902.00;  Legal in the amount of $4,003.00; Purchase Assets in the amount of $113,723; and Snow Removal in the amount of $1,673.00.  Total net income for the month of February, 2009 was -$126,494.00.  Looking at the Balance Sheet for the month of February, 2009, the fund balance for the general fund is $316,716.00; for the CIP account, the balance is $98,074.00; and the balance for the fixed assets fund is $383,938.00.  The total fund balance for the Town of Laytonsville for the month of February, 2009  is $798,728.00 

Council Member Kris Bradsher made the motion to approve the Treasurer’s Report for the month of  February, 2009 subject to audit.  Council Member Frank Bennett seconded.  Unanimously approved.

Discussion/Action Items:

BUDGET – FY 2010; TAX RATE FY 2010 – REAL PROPERTY: $.10 PER $100.00 OF ASSESSED VALUATION; PERSONAL PROPERTY: $.31 PER $100.00 OF ASSESSED VALUATION:    Mayor Oland noted that based on the proposed budget, the real property tax rate would be $.11 per $100.00 of assessed valuation and the personal property tax rate would be $.31 per $100.00 of assessed valuation.

 

 

 

Washington Suburban Sanitary Commission:  Mayor Oland noted that Ramona Davis, Project Manger for WSSC, was unable to attend the meeting.  Nineteen of the required 59 Rights of Way documents have been prepared for the Town of Laytonsville.  According to projections, construction start date is September, 2009.

 

ROUTE 108 OAK TREES REMOVAL – SURVEY:  Mayor Oland noted that an opinion letter dated February 9, 2009 from the Town’s Attorney, Stan Abrams, had been received regarding the oak trees.  Council Member Kris Bradsher stated that Maryland Hazardous Tree Code should be consulted as well as insurance coverage should be reviewed.  Eric Wenger noted that the Town’s consultant, Benning & Associates report prepared by Joshua Maisel is an official report prepared by a licensed arborist.

 

PROPOSED ORDINANCE TO AMEND PARKING ORDINANCE SO AS TO DEFINE THE TERM “STORAGE POD” AND REQUIRE THE ISSUANCE OF PERMITS RELATING TO THE PLACEMENT OF STORAGE PODS ON RESIDENTIALLY ZONED LAND:  Mayor Oland introduced the draft proposed ordinance  to amend the Town’s Parking Ordinance so as to define the term “Storage Pod” and to require the issuance of permits relating to the placement of storage pods on residentially zoned land.  The hearing for the proposed Ordinance will be April 7, 2009 prior the regularly-scheduled Town Council Meeting.

 

RESOLUTION TO AUTHORIZE MAYOR TO ENTER INTO AN AGREEMENT TO AUTHORIZE THE WSSC RIGHT-OF-WAY TO INSTALL A WATER DISTRIBUTION LINE AT THE PROPERTY KNOWN AS THE TOWN HALL:  Mayor Oland reviewed the draft Resolution to authorize the Mayor to enter into an agreement with WSSC to install a water distribution line at the Town Hall.

 

RESOLUTION OF THE MAYOR AND COUNCIL TO ESTABLISH A PARKING RULE RESTRICTING PARKING ON MAPLE KNOLL DRIVE WITHIN CERTAIN DESIGNATED TIMES:

Mayor Oland reviewed the draft Resolution to establish a parking rule restricting parking on Maple Knoll Drive to extend 386 feet east on the North and South side of Maple Knoll Drive from the intersection of Route 108.

 

LOT 1 AND LOT 2 LEN MAR PARK – MILLER LOTS:  Mayor Oland attended the settlement for these lots on February 13, 2009.  The Town of Laytonsville now owns approximately 23 acres of open/park land.

 

Town Leaf Pick Up:  Mayor Oland noted that Council Member Elect Jim Ruspi was unable to attend the meeting.  Mayor Oland stated that it would cost approximately $6,000-$8,000 for two bulk pick ups at owner’s property line.  The Town’s current contractor picks up yard waste at the curb once a week on Mondays for the period May through November.

 

Troop 1325 – Boy Scouts:  Mayor Oland acknowledge three scouts from Troop 1325.  Mike Donohue is their Scout Leader and they were participating in the Citizenship in the Community merit bade.  The three scouts introduced themselves:  Ian Donohue, Austin Donohue and Brett Donohue.

 

Town Parade:  The Town Parade will be May 16, 2009 and the theme is “Pride in Our Historic Heritage.”  The parade starts at 11:30 a.m.

 

Work Session – March 17, 2009:  The Work Session scheduled for March 17, 2009 has been cancelled.

 

Action: 

Town’s Proposed Budget for FY 2010:  Council Member Frank Bennett made the motion to approve the proposed budget for FY 2010.  Council Member Kris Bradsher seconded.  Unanimously approved.

Town’s Proposed Tax Rates for FY 2010:  Council Member David Preusch made the motion to approve the real property tax rate of $.11 per $100.00 of assessed valuation and the personal property tax rate of $.31 per $100.00 of assessed valuation.  Council Member Kris Bradsher seconded.  Unanimously approved.

Route 108 Oak Trees Removal – Survey:  Council Member Frank Bennett made the motion to engage Macris, Hendricks and Glascock of Montgomery Village, Maryland to conduct a survey of three parcels  at  21404, 21408 and 21412 Laytonsville Road to determine the State Highway Administration’s right of way.  Council Member David Preusch seconded.  Unanimously approved.

Citizens:

Sheree Wenger inquired about Program Open Space.  Mayor Oland responded that the Town was waiting for a second appraisal as required.  Mayor Oland noted that Council Member Kris Bradsher was investigating a similar program.

 

Council Member Frank Bennett made the motion to adjourn the regular meeting at 8:30 p.m.  Council David Preusch seconded.  Unanimously approved.

NOTE:  When there is a holiday on a normal trash/recycling pickup day, the next pickup will be on the next scheduled day.  Yard waste cannot be placed in plastic bags; yard waste must be in paper containers or in marked containers.  Yard waste will be picked up at the curb on Mondays for the period May through November.
