Meeting
minutes of Town Council on November 4, 2008
As
reviewed, approved, and accepted by the Town Council on December 2,, 2008
Mayor Oland called the regular Town Council meeting to
order at 7:32 p.m. Council Members, Frank Bennett, Kris Bradsher
and David Preusch were present. The Clerk and the Assistant Treasurer were present. There were four citizens present.
The
minutes of the regular Town Council Meeting on October 7, 2008 were approved as
submitted. The minutes of the Work Session
on October 21, 2008 were approved as submitted.
Treasurer’s Report: The Mayor reviewed the Profit and Loss Report
for the month of October, 2008: total income
for the month of October was $54,804.00. Income tax in the amount of $54,175.00 was received. Major expenses for October, 2008 were $3,139.00
for Waste Collection; and Accounting in the amount of $2,390.00. Total net income for the month of October,
2008 was $46,358.00. Looking at the
Balance Sheet for the month of October, 2008, the fund balance for the general fund
is $348,317.00 for the CIP account, the balance is $102,818.00 and the balance
for the fixed assets fund is $383,938.00. The total fund balance for the
Town of Laytonsville for the month of October, 2008 is $835.074.00
Council Member Frank Bennett made the motion to
approve the Treasurer’s Report for the month of October, 2008 subject to
audit. Council Member Kris Bradsher
seconded. Unanimously approved.
Discussion/Action Items:
WSSC Water Connection
Service Update: Mayor Oland noted that 100 total service
connection applications had been received by WSSC; 78 were Laytonsville
connections. Mayor Oland introduced
Ramona Davis, Project Manger, from WSSC.
Ms. Davis noted that out of a possible 187 connections, 100 service
connections applications had been received.
Ms. Davis also stated that property owners had until November 14, 2008 (final date) to submit service connection
applications.
Mayor Oland discussed the
Natelli property and whether the water main distribution was going up to the
future Route 108 By Pass and if that would include the property behind the
Natelli property. Ms. Davis commented that property was part of the
distribution system in 2010 or 2011.
Mayor Oland also noted that
the Town was very concerned about two oak trees next to the Laytonsville Volunteer Fire Department property. Mayor Oland requested that Ms. Davis send
finalized plans regarding placement of pipes at this location. Mayor Oland also requested that Ms. Davis
attend the January 6, 2009 regular Town Council Meeting for another update.
Draft Ordinance to Amend
Zoning Ordinance Section 104 Entitled “Definitions” to Enact New Subsections 104 (r) and 104 (s): Mayor Oland
stated that a Work Session was held on October 21, 2008 and an addition was
made to the Draft Ordinance. A new
Draft Ordinance was prepared by Stanley D. Abrams, Esq. to include in Section
104 (s) . . . “as defined in Sec. 104 (r).”
Clarification of Permitted
and Special Exception Uses in the Commercial Zone: Mayor Oland
noted that the Citizens Advisory Board should have final draft next week. Draft will be forward to Council for comment
and to Stanley D. Abrams. Mr. Abrams
will draft Ordinance for Zone Text Amendment.
The Draft Ordinance will be introduced at the December 2, 2008 regular
Town Council meeting and a hearing will be held on January 6, 2009.
Local Government Insurance
Trust – Personnel and Safety/Health Policies: Mayor Oland noted that no
comments had been received from Council Members. The draft policies will be forwarded to Stanley D. Abrams for
comments. Mr. Abrams will prepare a
Draft Ordinance or Resolution to adopt them.
Local Government Insurance
Trust – Safety Inspection Log: A log for the review of the Town’s
sidewalks, streets, Town Hall and Town Hall grounds inspection was
distributed. A review must be done
quarterly. Council Member Frank Bennett
will conduct the October – December, 2008 review.
Annual Holiday Tree
Lighting: The tree lighting will be on December 5, 2008 at the Town
Hall. LVFD, Laytonsville Elementary
School, Cub Scout Pack 1323, Girl Scout Troop 2796, Daisy Troop 2755 and Daisy
Troop 3767 are participating.
First Street: Mayor Oland
discussed the deterioration of the pavement on First Street at Sundown. Mayor Oland requested through Francis Hewitt
that when F.O. Day was in the area, they complete the repair at a cost of
approximately $12,000 for 2,470 square feet of payment.
Action:
Approve “Definitions”
in Subsections 104 (r) and 104
(s)of the Zoning Ordinance: Council Member Frank Bennett made the motion to
approve the definitions developed in the Work Session on October 21, 2008 and proposed
as follows:
(r) “Self
Storage Buildings”: Means a building or part of a building used for storage
of documents, furnishings and equipment, personal effects and similar personal
property which is not intended to be processed, assembled, sold, leased or
otherwise used in the conduct of a business or commercial venture and where
access is to such building or part of a building is afforded directly to the
tenant or lessee.
(s) “Warehouse
and Storage Buildings”: A building or part of a building for storing
documents, equipment, wares and merchandise whether for the owner or others
where access to such building is afforded only to the owner of such building.
Warehouse and storage buildings shall not include self storage buildings as
defined in Sec. 104 (r).
Council Member Kris Bradsher seconded. Unanimously
approved.
This approval was for definitions only. A Zoning Text Amendment containing these
definitions will be introduced December 2, 2008.
First Street: Council Member Frank Bennett made the motion
to approve the approximately $12,000 proposal from F.O. Day to rehabilitate and
improve the pavement at First Street and Sundown Roads. Council Member David Preusch seconded. Unanimously
approved.
