Meeting
minutes of Town Council on August 5, 2008
As
reviewed, approved, and accepted by the Town Council on September 2, 2008
Mayor Oland called the regular Town Council meeting to
order at 7:45 p.m. Council Members, Frank Bennett, and Charles
Bradsher, were present. Council
Member-Elect Jim Ruspi was present. Council Member David Preusch was absent. The Clerk and Treasurer were present. There were three citizens present.
The
minutes of the regular Town Council Meeting on July 1, 2008 were approved as
submitted.
Treasurer’s Report: Reviewing the Profit and Loss Report for the
month of July, 2008: total income for the month of June was $1,351.00, which
includes Property Tax in the amount of $1,054.00. Major expenses for July, 2008 were $2,734.00 for Waste Collection;
Grounds Maintenance in the amount of $2,715.00; Legal in the amount of
$3,503.00; and Accounting in the amount of $2,529.00. Total net income for the month of July, 2008
was -$18,840.00. Looking at the Balance
Sheet for the month of July, 2008, the fund balance for the general fund is $300,667.00;
for the CIP account, the balance is $99,219.00 and the balance for the fixed
assets fund is $383,938.00. The total fund balance for the Town of
Laytonsville for the month of July, 2008 is $783,824.00.
Council Member Frank Bennett made the motion to
approve the Treasurer’s Report for the month of June, 2008 subject to
audit. Council Member Charles Bradsher
seconded. Unanimously approved.
Discussion/Action Items:
Proposed Ordinance to
Adopt with Minor Modifications, Chapter 31 – Montgomery County Code: Mayor
Oland noted that Town Counsel, Stanley D. Abrams, Esq., had reviewed the
Ordinance and Agreement.
Jones Farm/Rolling Ridge
Subdivision – Access Easement, Parcels C and D: Mayor Oland
introduced Mike Bingley, ElmStreet Development. Mr. Bingley noted that the two properties ElmStreet owns are
beyond the Town’s boundary. ElmStreet
needs access to these properties for maintenance and possible building lot. Mr. Bingley noted there would be no
additional liability for the Town.
Miller Lots – Lots 1 and
2, Block C, Len Mar Park: Mayor Oland reviewed reports on the sale of
finished lots in the Town. Mayor Oland
would like to go forward for an appraisal for the Lots 1 and 2, Block C in Len
Mar Park. It was agreed by consensus to
obtain an appraisal for these lots.
Goshen Enterprises Inc.: Mayor Oland
reviewed a quote in the amount of $2,670.00 to regrade the area behind the
parking lot at the Town Hall. Topsoil is
to be imported to create a smooth transition from the parking area to the lawn
area; entire area to be seeded and straw to be applied. This proposal will be further discussed in
September.
Montgomery County
Ambulance Fee: Mayor Oland reported that the Laytonsville
Volunteer Fire Department is in opposition to the proposed ambulance fee. Mayor Oland also requested that the Council
consider the placement of a sign on Town Hall property opposing the ambulance
fee. It was agreed by consensus to
allow the LVFD to place a sign opposing the ambulance fee on the Town Hall
property.
Town Picnic: Mayor Oland
reported that the Town Picnic will be held on September 20, 2008.
Work Session – August 19,
2008: The Mayor and Council have cancelled the Work Session for August
19.
Action:
Proposed Ordinance to Adopt with Minor Modifications,
Chapter 31 – Montgomery County Code: Council Member
Frank Bennett made the motion to adopt the proposed Ordinance to amend
Ordinance No. 01-04 and to adopt with minor modifications, Chapter 31 “Motor
Vehicles and Traffic” of the Montgomery County Code. Council Member Charles Bradsher seconded. Unanimously approved.
Jones Farm/Rolling Ridge Subdivision – Access
Easement, Parcels C and D: Council Member Frank Bennett made the motion
to authorize the Mayor to sign the Access Easement for Parcels C and D as it
pertains to the Rolling Ridge Subdivision.
Council Member Charles Bradsher seconded. Unanimously approved.
Council:
Citizens:
Sheree Wenger, Chair of the Historic District
Commission, reported that she had met with Jeffrey F. Winstel, AICP, who is the
Lead Historic Preservation Planner for the City of Rockville and who is
conducting a course at the University of Maryland Mr. Winstel wants to use homes in the Town’s for his class
research. Eighteen homes of historic
significance have been chosen and students will conduct extensive research on
them. Letters will be sent to
residents.
Council Member Frank Bennett made the motion to
adjourn at 8:26 p.m. Council Charles Bradsher seconded. Unanimously
approved.
