Meeting
minutes of Town Council on December 4, 2007
As
reviewed, approved, and accepted by the Town Council on January 8, 2008
Mayor Oland called the regular Town Council meeting to
order at 8:05 p.m. The Mayor and
Council Members Frank Bennett, Charles Bradsher, David Preusch and Tom
Wilkinson were present. The Acting Clerk
was present. There were fourteen
citizens present.
The
minutes of the regular Town Council Meeting on November 6, 2007 were approved as submitted. The minutes of the Public Hearing on November
6, 2007 were approved as submitted. The
minutes of the Work Session of November 13, 2007 were approved as submitted.

Discussion/Action Items:
Stadler Preliminary
Plan: Mr. Pete Stadler was present with Mr. Witmer to submit
the preliminary plan for the Laytonsville Manor subdivision. 107 acres located in the R3 zone. Results at this time yield 47 lots. The plan will be given to Stan Benning, Town
Planner, for comment.
Proposed Amendment to the
Preliminary Plan submitted by Laytonsville LLC: Laytonsville
LLC met with the Elementary School and
the PTA their written opinion is part of the record. (Representative of the Town were also in attendance: Mayor Oland, Council Member Frank Bennett
and Town Planner, Stan Benning.)
Maryland Department of
Planning: Mr. Mike Nortrup from MD Dept of Planning informed the Mayor and
Council of the changes to 66B and its effect on Comprehensive Plans. He recommended that the planning commission
be appointed as soon as possible. He
also discussed the Municipal Growth element and explained what the Dept of
Planning can provide. They can submit
the plan for review to the proper agencies.
Rolling Ridge Subdivision
– Lot 12 Building Permit: Joe Korcinsky with NVHomes submitted a
permit for Lot 12. A couple questions
were cleared up and the permit will be issued.
Mr. Bingley – Elm Street
Development reported that the work to the pond on Rolling Ridge is
complete. The historic house has been
sold to Mr. Brian DaVilla.

Resolution to Defer Decision
for Reclassification Application for property Located at 21415 Laytonsville
Road: Resolution for meeting to be held on Jan 8, 2008 made
by Tom Wilkinson, seconded by Bud Bennett. Approved
unanimously.
Zoning Text Amendment to
Section 127 to Add Definition for the Term “Contributing Resources”: Amend
section 127 to add definition of contributing resources made by David Preusch
seconded by Bud Bennett. Approved
unanimously.
Rolling Ridge Subdivision
– Lot 12 Building Permit: Lot 12 motion to issue permit made by Bud Bennett,
seconded by David Preusch. Approved unanimously.
Proposed Amendment to the
Preliminary Plan Submitted by Laytonsville Communities, LLC – Fulks South Subdivision: Preliminary
plan amendment submitted by Laytonsville LLC, motion made to close the record
by Bud Bennett.
Second by Dave Preusch. Approved.
Motion to approve the concept
of the round about made by Bud Bennett.
Second by Tom Wilkinson. Approved.
Motion to decline the request
to amend the preliminary plan submitted by Laytonsville LLC, which illustrated
that the roundabout be abandoned and a T intersection be constructed, made by
Bud Bennett. Second Tom Wilkinson. Approved.
Mr. Buddy Sutton,
Laytonsville Volunteer Fire Department, stated that he felt this move would
jeopardize the safety of the fire equipment as well as pedestrians. They are not in favor of the roundabout. Questioned how to control traffic in a
circle in the case of an emergency. He noted that the traffic dumping from a
full service fire station could cause problems. Dale Johnson also opposes the roundabout.
Josh Pomeroy – It is up to
Natelli to come up with a plan to meet the requirements. This does not preclude them from requesting
any future amendments to the plan should the roundabout not come to fruition.

adjourn at 9:09 p.m. Council Charles Bradsher seconded. Unanimously
approved.
