Meeting minutes of Town Council Meeting on January 2, 2007                      

As reviewed, approved, and accepted by the Town Council on February 6, 2007       

 

The Public Hearing to consider a proposed Ordinance to adopt Chapter 7A of the Montgomery County Code entitled “Off-The-Road Vehicles” as being applicable within the Town and to authorize Montgomery County to apply, administer and enforce the provisions of Chapter 7A within the Town limits was called to order at 7:30 p.m. by Mayor Oland.

With no further public testimony, Mayor Oland closed the hearing at 7:32 p.m.

 

 

 

 

The regular meeting of the Mayor and Town Council was called to order by Mayor Oland at 7:35 p.m.  The Mayor, Council Members Frank Bennett, David Preusch, Charles Bradsher and Tom Wilkinson were present.   The Clerk and the Treasurer were present. There were 4 citizens present.

The minutes of the regular Town Council Meeting on December 5, 2006 were approved as submitted.

Treasurer’s Report:  Reviewing the Profit and Loss Report for the month of December, 2006, total income for the month of December, 2006 was $3,816.00.  Major expenses for December, 2006 were $ 1,092.00 for grounds maintenance, $1,230.00 for heating fuel; $3,344.00 for legal expenses; and $2,568.00 for waste management.  Looking at the Balance Sheet for the month of December, 2006, the fund balance for the general fund is $245,698.00; for the CIP account, the balance is $75,276.00 and the balance for the fixed assets fund is $384,904.00.  The total assets for the Town of Laytonsville for the month of December, 2006 are $705,878.00. 

Council Member Frank Bennett made the motion to approve the Treasurer’s Report subject to audit.  Council Member David Preusch seconded the motion.  Unanimously approved.

 

 

Discussion/Action Items:

Resolution of Intent to Enter the National Flood Insurance Program:  Mayor Oland reported that the Maryland Department of Environment and Montgomery County submitted materials for review.  The material was original distributed at the March 7, 2006 regular Town Council Meeting.

Resolution to Adopt Certain Flood Protection Measure and to join the National Flood Insurance Program for a non-Floodprone Community:  Mayor Oland reported that the Town is not in a floodplain; however by joining the National Flood Insurance Program, residents are able to purchase flood insurance if so desired.   The application, if approved, will be submitted to Maryland’s Department of the Environment.  By consensus, the current sitting Mayor was approved as the Floodplain Coordinator.

Sidewalk at Stadler’s Nursery:  Mayor Oland reported that the sidewalk on Route 108 in front of Stadler’s Nursery has been extended by the Stadler family.  Mayor Oland wanted to officially recognize the Stadler family for their contribution.

Verizon Cable Communications:  Mayor Oland reported that the Town is in the second phase for cable communications.

Town Hall Pavilion/Porch:  Mayor Oland reported that the Historic District Commission is holding a hearing on January 18, 2007 to receive public testimony regarding construction of a pavilion and the replacement of the front porch at the Town Hall.  The last quote received for the pavilion was $21,975.  Mayor Oland requested consideration of an authorization that would allow him to negotiate with a vendor.

Local Insurance Government Insurance Trust:  LGIT has recommended that the Town consider the formation of a Hazard Safety Team to review such hazard items that may be apparent in roads, sidewalks, buildings, etc. 

Action Items:

Town Hall Pavilion:  Council Member David Preusch made the motion to approve a budget of up to $25,000 for the purchase of the Town Hall pavilion, excluding paving and electrical work.  Council Member Tom Wilkinson seconded.  Unanimously approved.

Council: 

Council Member David Preusch reported that there was a bad accident at Route 108 and Warfield.  Pete Stadler suggested a light be installed at Maple Knoll Road and Route 108.  Sheree Wenger suggested requesting that Montgomery County set up police radar again the Town.  Council Member David Preusch also reported that there had been two car break-ins on Mobley Farm Drive last month.

Citizens:

Sheree Wenger reported that Rolling Ridge Lane has been paved.

Claire Stadler Rosser reported that the Stadler Family Agricultural Easement was being reviewed by Town counsel.

Work Session – January 16, 2007:  The Mayor and Council have cancelled the Work Session scheduled for January 1, 2007.

Council Member Tom Wilkinson made the motion to adjourn at 8:15 p.m.  Council Member Frank Bennett seconded.  Unanimously approved.
