Meeting minutes of Town Council Meeting on May 2, 2006                      

As reviewed, approved, and accepted by the Town Council on June 6, 2006

 

 

The regular meeting of the Mayor and Town Council was called to order by Mayor Oland at 7:30 p.m.  The Mayor, Council Members Frank Bennett, David Preusch, and Tom Wilkinson were present.  Council Members Charles Bradsher and David Halperin were absent.  The Clerk and the Treasurer were present.  There were 6 citizens present.

The minutes of the Public Hearing to consider the remaining house styles submitted by NV Homes (Rolling Ridge) on Lots # 6, 7, 8, 9, 10, 11, and 12 held on April 4, 2006 and the minutes of the regular meeting of April 4, 2006 were reviewed.  The minutes were approved as submitted.  The minutes of the Work Session held on April 18, 2006 were reviewed and approved as submitted.

Treasurer’s Report:  Reviewing the Profit and Loss Report for the month of April, 2006, a source of income was $1,850.00 in zoning fees and $286.89 in interest income.  Total income for the month of April, 2006 was $2,873.00.  Major expenses for April, 2006 were $1,083.00 in legal fees; and $3,077.00 in payroll expenses.  Total expenses for the month of April, 2006 were $5,273.00 with addition of CIP interest, total net income is a  -$47.00.  Looking at the Balance Sheet for the month of April, 2006, the fund balance for the general fund is $182,375.00; for the CIP account, the balance is $58,137.00; and the balance for the fixed assets fund is $384,904.00.  The total assets for the Town of Laytonsville for the month of April, 2006 are $625,416.00.    Council Member David Preusch made the motion to accept the Treasurer’s Report as submitted, subject to audit.  Council Member Tom Wilkinson seconded.  Unanimously approved.

Discussion/Action Items:

Election Results:  The election was held on May 1, 2006.  The results were:  Charles Bradsher – 27 votes; David Halperin – 27 votes; and Tom Wilkinson – 28 votes.  A Special Election will be held on May 15, 2006 at the Town Hall from 3:00 p.m. until 8:00 p.m.  Mayor Oland congratulated Tom Wilkinson on his election to a Council Member position.

Electricity Aggregation:  Mayor Oland reported that the Town participates with Montgomery County in the aggregation purchase of electricity for a fixed price for a period of two years.  We are awaiting a price breakdown from Montgomery County.

 

Ownership of Outlots:  Mayor Oland reported that in a memorandum dated April 18, 2006 from legal counsel, Stanley D. Abrams, it was determined that unless outlots are dedicated as part of the platting process or by separate deed of dedication or by out-right conveyance to the municipal jurisdiction, they remain under the private ownership or control of the original developer or a homeowner association or condominium association created by the developer.  It is Mayor Oland’s opinion that regarding Outlot B and the trails in the Rolling Ridge subdivision, that the Town should take ownership and control.  Town Planner, Stanley Benning reported that the Town should look at the creation of  language in the Homeowners Association documents addressing the responsibilities to maintain and the nature of funding of such maintenance when it falls under the Homeowners Association responsibility.  Mike Bingley, representative from Elm Street Development (Rolling Ridge) reported that Outlot A  would probably be owned by  adjacent homeowner(s).  Mr. Bingley reported that the builder and the purchasers would contribute enough money to fund any maintenance.  The Homeowners Association would further be responsible to maintain the storm water management areas and the entrance monument to the subdivision.

Rolling Ridge Record Plat:  Mayor Oland reported that Council Member Frank Bennett and Town Planner, Stanley Benning have reviewed the final record plat submitted by CPJ Associates for the Rolling Ridge Subdivision.  Council Member Frank Bennett questioned the top corner adjacent to Lot 9 and noted that had not been identified on the record plat.  Mr. Bingley reported that he had created a metes and bounds and will sell this portion to the Town for $1.00 to simplify the property line.  Mayor Oland reported that ElmStreet has completed the Town’s requirements for the submission of a record plat for the Rolling Ridge Subdivision. 

Stan Benning questioned the slope easements.  Mike Bingley reported that there is a 25’ easement on that side of the right-of-way

Mr. Bingley delivered the signed Forest Conservation Maintenance Agreement.

District 14 Delegates:  Mayor Oland reported that the three Delegates and Senator Rona Kramer have been invited to the June regular Town Council meeting.

WSSC Elevated Water Storage Tank:  Mayor Oland reported that a letter has been sent to WSSC  setting forth requirements the Town of Laytonsville would request relative to the water storage tank to be erected on the Natelli property at Warfield Road and Route 108.

Sidewalk on Route 108:  Mayor Oland reported that Pete Stadler will extend the sidewalk from its present terminus  to the Town property line.  Most of the sidewalk will be asphalt.

Round-about at Brink, Route 108 and Sundown:  Mayor Oland has received a letter from the State Highway Administration indicated that this round-about is presently in the concept development stage.  The status of this funding will be determined later this spring.

Radar:  Mayor Oland reported that Montgomery County police have set up radar with in the Town limits several times within the last month.

Preliminary Plan – Rosewood Manor Estates:  Maryland National Capital Park & Planning has mailed the preliminary plan for two houses to be constructed in Rosewood Manor.

Historic District Commission Vacancy:  A flyer will be distributed indicating the Historic District Commission has one vacancy.

Town’s Water Storage Tank:  A flyer will be distributed requesting ideas for painting the Town’s Water Storage Tank.

Work Session – May 16, 2006:  The Mayor and Council have cancelled the Work Session scheduled for May 16, 2006.

Committee to Preserve the Reserve:  On June 8, 2006 at 7:30 p.m. at St. Paul Methodist Church, a community meeting will be held by the Committee to Preserve the Reserve.

Town Hall:  Mayor Oland thanked Complete Lawn Care (Wengers) for sending a crew to spray and fertilize the Town Hall’s lawn.

Pavilion at Town Hall:  Mayor Oland has received material regarding pavilion kits for the construction of a pavilion.  Brochures were distributed to Council Members for their review. 

Action Items:

Ownership of Outlots:  Council Member David Preusch made the motion that Parcel A in the Rolling Ridge subdivision would be sold separately to an adjacent homeowner.  Council Member Tom Wilkinson seconded.  Unanimously approved.

Council Member Tom Wilkinson made the motion that Parcel B and the trails within Parcel B of the Rolling Ridge subdivision would be owned by the Town of Laytonsville.   Council Member Frank Bennett seconded.  Unanimously approved.

Mayor Oland requested that ElmStreet Development deed Parcel B and the trails within Parcel B to the Town of Laytonsville.  Stan Benning suggested a condition be added: that the deed should be conveyed “prior to the sale of the last lot.”

Council Member Frank Bennett made the motion to approve the three record plats submitted by CPJ and Associates for the Rolling Ridge subdivision.  Council Member Tom Wilkinson seconded.  Unanimously approved.

 

 

 

Council:

Council Member David Preusch inquired as to the electrical requirements for the 2006 picnic.

Citizens:

Phyllis Sterling questioned the liability costs the Town would incur when the Town takes ownership of the pond located in the Rolling Ridge subdivision.  Mayor Oland reported that Local Government Insurance Trust covers the Town with general liability.

Mrs. Sterling questioned easements on the sidewalk at Stadler’s property.  Mr. Stadler will grant an easement to the Town.

Mark and Christine Katz inquired about the property located at 21415 Laytonsville Road             which is currently for sale.  They were referred to the Town’s Zoning Ordinance and Master Plan.

Council Member Frank Bennett made the motion to adjourn at 8:50 p.m.  Council Member Tom Wilkinson seconded.  Unanimously approved.
