Meeting minutes of Town Council Meeting on March 7, 2006

Mayor Oland called the Public Hearing to consider the 2006-2007 Town of Laytonsville budget to order at 7:30 p.m.   The Mayor, Council Members Frank Bennett, David Preusch, and Tom Wilkinson were present.  The Clerk and The Treasurer were present.  There were 8 citizens present.  Treasurer Christine Wilkinson reviewed the proposed budget:  Projected real estate property taxes income is $70,000.00 for period ending June 30, 2006; it is anticipated that additional monies in income and real estate taxes will be received as a result of the thirteen additional residences to be built on the Rolling Ridge property.  The total proposed income for the year ending June 30, 2007 is $164,700.00.  In reviewing expenses:  the budget is on target for the 2005-2006 fiscal year with no significant changes.  The total proposed expenses for the year ending June 30, 2007 are $$164,200.00.  The real estate tax rate is currently set at $.160 per $100 of assessed value; the proposed tax rate is $.140 per $100 of assessed value.  Mayor Oland opened the floor for public comment.  Mayor Oland noted that the Notice of Public Hearing had been distributed to residents and copies posted at the Town Hall and the Post Office. There being no public comment, the Mayor closed the Public Hearing to consider the 2006-2007 budget at 7:35 p.m.  The Ordinance to adopt the Town budget for the fiscal year July 1, 2006 through June 30, 2007 and to levy an ad valorem tax on all assessable property within the Town will be voted upon at the April 4, 2007 regular Town Council meeting.

The regular meeting of the Mayor and Town Council was called to order by Mayor Oland at 7:35 p.m.  The Mayor, Council Members Frank Bennett, David Preusch, and Tom Wilkinson were present.  Council Members Charles Bradsher and David Halperin were absent.  The Clerk and the Treasurer were present.  There were 8 citizens present.

The minutes of the regular meeting of March 7, 2006. were reviewed.  The minutes were approved as submitted with an addition to Council Member Preusch’s comments on page four to include parking “school buses.”

Treasurer’s Report:  Reviewing the Profit and Loss Report for the month of February, 2006, a source of income was $625.00 in real property taxes.  Total income for the month of February, 2006 was $4,107.00.  Major expenses for February, 2006 were 1,100.00 in land planning; $1,399.00 in payroll expenses and $2,568.00 in waste collection expenses.  Total expenses for the month of February, 2006 were $5,787.00 for a net income of -$1,680.00.  Looking at the Balance Sheet for the month of February, 2006, the fund balance for the general fund is $179,350.00; for the CIP account, the balance is $54,837.00; and the balance for the fixed assets fund is $384,904.00.  The total assets for the Town of Laytonsville for the month of February, 2006 are $619,091.00.    Council Member Frank Bennett made the motion to accept the Treasurer’s Report as submitted, subject to audit.  Council Member David Preusch seconded.  Unanimously approved.

Discussion/Action Items:

Auditor: Lindsey & Associates  – Christine Wilkinson introduced Bob Diss, Lindsey & Associates.  Mr. Diss reviewed the Town of Laytonsville’s audit for the fiscal year ending June 30, 2005 and noted:  there were no significant changes in the scope of the audit; the Town has received an unqualified opinion; there were no disagreements with management; Lindsey & Associates received the full cooperation of Town staff and had full access to Town records; no material weaknesses were noted.  Copies of the audit were distributed to Council members and are available through the Treasurer’s office.

Ordinance to Adopt Budget - The Ordinance to adopt the Town budget for the fiscal year July 1, 2006 through June 30, 2007 and to levy an ad valorem tax on all assessable property within the Town was introduced.  Copies of the proposed Ordinance were distributed.  The Ordinance will be voted on at the April 4 regular Town Council Meeting.

Election Judges:  Mayor Oland recommended the following as Election Judges for the May 1, 2006 General Election:  Barbara White, Dottie Tessier, Michele Shortley and Ruth Bennett.  Alternate Election Judges would be Jill Ruspi and Jake Cecere.  Mayor Oland noted that voter registration is required of all residents to be able to vote in the May 1, 2006 election.  If a resident is not registered on the Montgomery County’s Voter Registration List, they can register on the Town’s Supplemental Voter Registration List by submitting  a written request to the Town of Laytonsville, P.O. Box 5158, Laytonsville, MD  20882 indicating name, address, age as of the date of the election and their signature.  Registrations must be as of April 1, 2006 to be able to vote in the May 1, 2006 election.

Resolution to Adopt Flood Protection Measures and to Join the National Flood Insurance Pr9ogram for a non-Floodprone Community; Resolution of Intent to Enter the National Flood Insurance Program:  Mayor Oland noted that Laytonsville is not within a designated floodprone area; however FEMA, the State of Maryland and Montgomery County have requested that municipalities join the NFIP (National Flood Insurance Program).  A draft Resolution was distributed for review.

Speed Camera – Route 108:  Mayor Oland has written to Joseph Beach, Assistant Administrative Officer in Montgomery County requesting that a speed camera be installed on State Route 108 within the Town.

Maryland Emergency Management Agency:  Mayor Oland noted that Montgomery County had supplied the Town with Emergency and Preparedness materials which are available at the Town Hall.

Annexation Legislation:  Mayor Oland noted that legislation has been introduced that would limit municipalities in their efforts to annex.  SB 1013 and HB 1640 have been introduced by the Maryland Municipal League to protect municipalities.  Mayor Oland recommended that Council Members contact their Delegates to support SB 1013 and HB 1640.

Action Items:

Election Judges:  Council Member Tom Wilkinson made the motion to appoint Barbara White, Dottie Tessier, Michele Shortley and Ruth Bennett as Election Judges; and to appoint Jill Ruspi and Jake Cecere as Alternate Election Judges.  Council Member David Preusch seconded.  Unanimously approved.

Work Session:  It was agreed by consensus that the Work Session scheduled for March  21, 2006 will be cancelled.

Council:

Council Member David Preusch reported that five individuals had been arrested in a recent burglary that occurred in Laytonsville.

Citizens:

Charles Hendricks questioned the proposed Round-about at Brink and Route 108.  Mayor Oland to contact the State Highway Administration to determine status.

Council Member Tom Wilkinson made the motion to adjourn at 8:20 p.m.  Council Member Frank Bennett seconded.  Unanimously approved.
