Meeting minutes of Town Council Meeting on January 3, 2006                      

As reviewed, approved, and accepted by the Town Council on February 7, 2006

 

 

The regular meeting of the Mayor and Town Council was called to order by Mayor Oland at 7:30 p.m.  The Mayor, Council Members Frank Bennett, David Preusch, and David Halperin were present.   The Clerk was present.  There were 3 citizens present.

 

The minutes of the regular meeting of December 6, 2005 were reviewed.  The minutes were approved as submitted. 

 

Treasurer’s Report:  Reviewing the Profit and Loss Report for the month of December, 2005, major sources of income was $1,224.00 in real property taxes.  Total income for the month of December, 2005 was $2,465.00.  Major expenses for December, 2005 were $1,500.00 for repairs and maintenance for the Town Hall, $2,167.00 for payroll, $1,100.00 for snow removal and $2,568.00 in waste collection expenses.  Total expenses for the month of December, 2005 were $6,956.00, for a net income of $-7,247.00.  Looking at the Balance Sheet for the month of December, 2005, the fund balance for the general fund is $165,520.00; for the CIP account, the balance is $51,594.00; and the balance for the fixed assets fund is $384,904.00.  The total assets for the Town of Laytonsville for the month of December, 2005 are $602,018.00.    Council Member Frank Bennett made the motion to accept the Treasurer’s Report as submitted, subject to audit.  Council Member David Halperin seconded.  Unanimously approved.

 

Discussion/Action Items:

 

Town Hall Storm Windows:  Mayor Oland reported that a quote was received from Gaithersburg Glass Company, Inc. in the amount of $3,212 to provide tempered interior storm windows for the 16 windows in the Town Hall.  Mayor Oland does not think it is feasible to go forward with the proposal.

 

Resolution to Support Proposed Legislation by Montgomery County Council Members – Multi-Use Septic Systems;  TDRs:  A draft Resolution was reviewed by the Mayor and Council to support  Montgomery County Council Member Michael Knapp’s Text Amendment to the Ten Year Comprehensive Water Supply and Sewerage System Plan re Multi-Use On-Site Septic systems and Council Members Subin and Floreen’s Zoning Text Amendment regarding the Rural Density Transfer Zone. 

 

 

 

1.    Council Member Knapp's Amendment to Montgomery County's Comprehensive

Ten-Year Water Supply and Sewerage Systems Plan regarding Multi-use On-site Systems. The Knapp amendment would impose a capacity restriction calculated for each property by determining the maximum number of residential units that could be constructed based on current zoning requirements, and multiplying that total by 600 gallons, which reflects current assumptions for expected maximum flows produced by residents in a four-bedroom house.    This amendment needs to be amended to define usage as actual daily peak flow.

 

2.       Council Member Subin 's Amendment to the Montgomery County Zoning

Ordinance. The Subin amendment would codify that a Transferable Development Right ("TDR”) Easement governing real property, in addition to limiting the construction of one-family dwellings, prohibits the construction of any non-residential use on the property, other than for agricultural uses as defined in Montgomery County Code Section 59-A-2. The amendment would also exclude land zoned RDT that is used for a public purpose or developed for commercial or industrial purposes from a landowner's calculation of TDRs available for transfer, or if such TDRs already exist, require their extinguishment. Council Members Floreen and Knapp are co-sponsors of the Subin amendment.

 

 

A Public Hearing is scheduled on January 19, 2006 for the Montgomery County Council to review public comment.

 

Montgomery County Sanitation and Recycling:  Christmas trees will be picked up at curbside each Monday in January, 2006.  Trees are to be placed at curbside no later than 6:30 a.m. and all garland, tinsel and decorations should be removed.

 

Introduce Forest Conservation and Reforestation Ordinance Amendment:  A hearing to receive public comment regarding amended language to the Town’s Forest Conservation and Reforestation Ordinance so as to define the term “Linear Project”; to amend the definition of the term “Net Tract Area”; and  Section III entitled  “Application” will be held on February 7, 2006.  A draft copy of the Resolution was distributed to Council Members for their review.

Resolution to Support Proposed Legislation by Montgomery County Council Members – Multi-Use Septic Systems;    Council Member Frank Bennett made the motion to approve the Proposed Resolution to support  Montgomery County Council Member Michael Knapp’s Text Amendment to the Ten Year Comprehensive Water Supply and Sewerage System Plan re Multi-Use On-Site Septic systems and Council Members Subin and Floreen’s Zoning Text Amendment regarding the Rural Density Transfer Zone.   Council Member Dave Preusch seconded.  Unanimously approved.

Eric Wenger suggested that a sealing caulk could be used for the Town Hall windows to eliminate drafts.

Council Member Frank Bennett made the motion to adjourn at 8:12 p.m.  Council Member David Halperin seconded.  Unanimously approved.
