Meeting on October 4, 2005

The regular meeting of the
Mayor and Town Council was called to order by Mayor Oland at 7:30 p.m. The Mayor, Council Members Frank Bennett,
David Preusch, Charles Bradsher and David Halperin were present. The Town Planner, Stanley O. Benning was
present. The Clerk and the Treasurer
were present. There were 8 citizens
present.
The minutes of the regular
meeting of September 6, 2005 were reviewed.
Council Member David Preusch made the motion to approve the minutes of
the regular Town Council Meeting of September 6, 2005 as submitted. Council Member Frank Bennett seconded the
motion. Unanimously approved. The
minutes of the Public Hearings held on September 6, 2005 were reviewed. Council Member David Preusch made the motion
to approve the Public Hearing minutes of September 6, 2005 as submitted. Council Member Frank Bennett seconded. Unanimously
approved.
Treasurer’s Report: Reviewing the
Profit and Loss Report for the month of September, 2005, major sources of
income were $1,483.00 in real property tax and $1,318.00 reimbursement from Elm
Street Development (Jones Farm). Total
income for the month of September, 2005 was $3,507.00. Major expenses for September, 2005 were
$1,560.00 for grounds maintenance and demolition (two red sheds on Town Hall
property); $1,273.00 in legal expenses; $2,312.00 in payroll expenses; and
$2,271.00 in waste collection expenses.
Total expenses for the month of September, 2005 were $9,670.00, for a
net income of -$6,163.00. Looking at
the Balance Sheet for the month of September 2005, the fund balance for the
general fund is $131,461.00; for the CIP account, the balance is $43,805.00;
and the balance for the fixed assets fund is $384,904.00. The total assets for the Town of
Laytonsville for the month of September, 2005 are $560,170. Council Member Frank Bennett made the
motion to accept the Treasurer’s Report as submitted, subject to audit. Council Member David Halperin seconded. Unanimously
approved.
Town Picnic: Mayor Oland reported that the first-ever
Town of Laytonsville Town Picnic was a success on September 17, 2005 thanks to
the efforts of Jim O’Hair and the many sponsors and volunteers. A wrap-up meeting will be held on
October. It was agreed by consensus
that any profit from the picnic would be directed to the Hurricane Katrina
Relief effort.
J.B. Kline, Jr. Snow
Plowing Services: A contract has been received for the
2005-2006 season from J.B. Kline, Jr. Snow Plowing Services. The contract reflects an increase of $5.00
per hour for plowing services; spreading; materials; and a $10.00 increase in
treating sidewalks in the Town.
Lt. Gov. Michael S.
Steele: Lieutenant Governor Michael S. Steele will visit the Town of
Laytonsville on October 11, 2005. He
will arrive at the Town Hall at 9:30 a.m.
The Lt. Gov. and his staff will conduct a walking tour of the Tow to
include the Laytonsville Elementary School, the Laytonsville Volunteer Fire
Department, the newly-opened Pistachio Café and Stadler’s Nursery. Council Members should confirm their
attendance with the Clerk.
Jones Farm Property
(Rolling Ridge) Preliminary Plan, Phase II: Michael Bingley, Elmstreet
Development (Jones Farm Property – Rolling Ridge), Sally Stewart, Charles P.
Johnson and Associates and Sue Carter,
Miller, Miller and Canby reviewed the revisions requested by the Mayor, Council
and the Historic District Commission as they relate to Phase II of the
Preliminary Plan to include:
Mr. Bingley reported that the
revision reflected that the existing trees would remain on the Voit property
and a 30’ conservation easement at the rear of the Voit property.
The Town Planner, Stan
Benning, recommended approval of the Preliminary Plan of Subdivision for the
Jones Property, Phase II, as submitted subject to conditions.
Mayor Oland reported that a
letter dated September 27, 2005 from the Historic District Commission regarding
Phase II of the Preliminary Plan for the Jones Property (Rolling Ridge) had
been received and would be entered as a part of the record.
Montgomery County Council
Water and Sewer Service Category: Mayor Oland appeared before the
Transportation and Environment Committee of the Montgomery County Council on
September 29, 2005 and reported that the Town of Laytonsville would recommend
denial of the permit from the Derwood Bible Church requesting a change in the
water and sewer category classification for property located at Griffith Road
and Route 108.
Private Institutional
Facilities: On November 8, 2005 a hearing will be held at the Montgomery
County Council offices reviewing Private Institutional Facilities in the
Agricultural Reserve. It is the Town’s
position that PIFs should be reviewed as Special Exceptions in this zone.
Adopt Town – Maryland
Municipal League: The Town of Laytonsville has been in
discussion with the Maryland Municipal League and the leagues of Alabama,
Mississippi and Louisiana regarding the adoption of a similar-size Town to
assist in some monetary relief from the devastation caused by the recent
hurricanes.
School Bus Signage: A request has
been made by a resident of the Town to install a “School Bus Ahead” sign. Mayor Oland will contact Montgomery County
Department of Transportation.
WSSC - Laytonsville Pumping Station Site Evaluation
Study: The Site Evaluation Study has been received. Interested parties can obtain a copy from
the Town Clerk. WSSC is working with Laytonsville Elementary School to conduct
an information meeting.
Resolution to Increase
Sign Deposit Fee: A resolution to increase the sign deposit
fee for the Town of Laytonsville from $250.00 to $300.00 was discussed.
Work Session: The Mayor and
Council have cancelled the Work Session on October 18, 2005.
Action Items:

Plowing Services Contract: Council Member Frank Bennett made the motion
to accept the snow removal contract from J.B. Kline, Jr. Show Plowing Services
for the 2005-2006. Council Member
Charles Bradsher seconded the motion. Unanimously approved.
Jones Farm Property
(Rolling Ridge) Preliminary Plan – Phase II: Council Member Frank Bennett
made the motion to accept the revisions as submitted by the Town Planner, Mr.
Benning as they pertain to Phase II of the Preliminary Plan:
“A”. The outside curve of the driveway pavement
shown adjacent to Lot 6 and in an easement on Lot 12 will have minimum radius
of 100’.
“B”. The outside curve of the driveway pavement
of the two curves shown on Lots 10 and 11 shall have a minimum radius of 50’.
Council Member David Preusch
seconded the motion. Unanimously approved.
Resolution to Increase
Sign Deposit Fee: Council Member David Preusch made the motion
to increase the Town of Laytonsville’s sign deposit fee from $250.00 to $300.00
in accordance with Section 127.05 (d) of the Zoning Ordinance. Council Member David Halperin seconded. Unanimously
approved.
Council:
Council Member Frank Bennett
noted that two residents had recently cleared their yards and requested that
the Town send a letter of appreciation.
Council Member David Halperin
reported that his daughter, Heather Young, was donating a portion of her earned
proceeds to the Red Cross.
Citizens:
Eric Wenger inquired about wheeled
recycling bins. The Town’s contractor
does not provide wheeled bins.
Merritt Techter commended the
Town’s contractor on the special bulk pick up.
Phyllis Sterling reported
that the Committee to Preserve the Reserve appreciates the efforts of the Mayor
and Council and their interest in the Private Institutional Facilities issue as
it related to the Agricultural Reserve.
Council Member Frank Bennett
made the motion to adjourn at 8:40 p.m.
