Meeting minutes of Town Council Meeting on  August 2, 2005

August 2, 2005

 

 

The regular meeting of the Mayor and Town Council   was called to order by Mayor Oland at 7:30 p.m.   The Mayor, Council Members Frank Bennett,  David Preusch, Charles Bradsher  and David Halperin were present.  The Town Planner, Stanley O. Benning was present  The Clerk and the Treasurer were present. There were 7 citizens present.

 

 

 Council Member David Preusch made the motion to approved the minutes of the regular Town Council Meeting on July 5, 2005 with the correction to page 4 Tucker Text Amendment, remove cored and add “record”; and that Council Member Charles Bradsher seconded the motion to adjourn the meeting.  The minutes of the regular Town Council Meeting on July 5, 2005 were approved as submitted two corrections.

 

Treasurer’s Report: 

 

Treasurer’s Report:  Reviewing the Profit and Loss Report for the month of July, 2005, major sources of income were municipal tax duplicate payments in the amount of $13,244.00  Total income for the month of July, 2005 was $14,004.21.   Major expenses for July, 2005 were $1,011.76 for the security system; $1,333.00 for insurance; waste removal in the amount of $2,271.06 and $1,975.00 for signs.  Total expenses for the month of July, 2005 were $16,381.66, for a net income of $-2,377.45  Looking at the Balance Sheet for the month of July, 2005, the fund balance for the general fund is $143,052; for the CIP account, the balance is $51,834.00; and the balance for the fixed assets fund is $263,552.00.  The total assets for the Town of Laytonsville for the month of July, 2005 are $458,438.00.  Council Member David Preusch made the motion to accept the Treasurer’s Report as submitted, subject to audit.  Council Member Frank Bennett seconded the motion.  Unanimously approved

 

 

 

 

 

 

 

Discussion/Action Items:

 

Comprehensive Land Plan:   Mayor Oland reminded the meeting that the Comprehensive Land Plan had been drafted by the Citizens Advisory Board and submitted to Stanley D. Abrams, Town Counsel, for review.  Mr. Abrams responded in a letter dated June 24,

2005 that the Town should consider further adherence with Article 66B of the Maryland Code regarding the appointment of a planning commission.  Article 66B Paragraph 3.01 states that the municipal corporation “may” enact a plan and create by ordinance a planning commission with the powers and duties set forth in this Article.  Therefore, Mr. Abrams advises serious consideration to the creation and appointment of a planning commission before further action on the Comprehensive Land Plan.

 

Accordingly, discussion on the Comprehensive Land Plan has been tabled.

 

Town Picnic:  Mayor Oland reminded the meeting the Town is underwriting the cost of the Town picnic scheduled for September 17, 2005.  The Picnic Committee has planned to purchase tee-shirts with a logo and sponsors will underwrite this cost.  The next meeting of the Picnic Committee is Thursday, August 4, 2005 at 7:00 p.m. in the Town Hall, 21607 Laytonsville Road.

 

Proposed Route 108 By-Pass:  Mayor Oland reported that Council Member David Preusch and the Mayor met with Senator Rona Kramer and Council Member Mike Knapp before the regular Town Council meeting on July 5, 2005.  Council Member Mike Knapp indicated he would take the assignment to get the Olney Master Plan amended to include the proposed By-Pass.

 

Introduce  Proposed Building Permit Ordinance Amendment:  Mayor Oland introduced a proposed Ordinance to amend the Town of Laytonsville’s Building Permit Ordinance so as to authorize and require the posting of a bond or other security when issuing building permits where damage to Town of public property or public rights-of-way may occur.  The public hearing is scheduled for September 6, 2005 starting at 7:30 p.m. at the Town Hall, 21607 Laytonsville Road to receive comment.  Copies of the proposed Ordinance will be available at the Town Hall during regular business hours and will be available at the hearing.

 

Introduce Proposed Elections Ordinance:  Mayor Oland introduced a proposed Ordinance to establish procedures and regulations with respect to regulating elections with the Town of Laytonsville.  The public hearing is scheduled for September 6, 2005 after the above hearing at the Town Hall, 21607 Laytonsville Road to receive comment.  Copies of the proposed Ordinance will be available at the Town Hall during regular business hours and will be available at the hearing.

 

 

Sterico Sign Proposal:  Mayor Oland submitted a proposal from Sterico Signs for a solar-powered LED sign light in the amount of $1,920.45.  It was agreed by consensus to obtain further information regarding illumination of the Welcome Signs.

Mayor Oland noted that the smaller Welcome Sign had been installed at the Brink Road entrance to the Town.

 

Derwood Bible Church:  Mayor Oland distributed a draft copy of recommendations made by the Committee to Preserve the Reserve and noted that the Town will take a position on the following matters:

 

 

 

 

Council Member Dave Preusch asked Stan Benning about the current zoning language.  Mr. Benning responded that the current language in the Montgomery County’s zoning text is insufficient.  Mr. Benning noted that 60+ acres of tested land would be required to support Derwood Bible Church’s septic requirements.

 

Mayor Oland requested that the Council review the submitted material and would recommend that the Mayor and Council of the Town of Laytonsville recommend to the County Council that they consider PIFs  as special exceptions in the Agricultural Zone.  Mayor Oland further recommended that the Mayor and Council of the Town of Laytonsville should go on record that the Town is against granting approval for the application for a permit for private well and septic disposal systems.  Council Member David Halperin made the motion that the Town of Laytonsville would go on record that the Mayor and Council is against granting approval for the Derwood Bible Church’s application for a permit for private well and sewage disposal systems and the Mayor and Council is also opposed to a change of the Ten Year Comprehensive Water Supply and Sewerage System Plan for a water and sewer category change requested by Derwood Bible Church.  Council Member Frank Bennett seconded.  Unanimously approved.  

 

Further discussion will be held at the September 6 regular Town Council meeting.

 

Work Session on August 16, 2005:  The Mayor and Council have cancelled the Work Session on August 16, 2005.

Mr. Robert Ludwig questioned if traffic studies had been conducted as it relates to the proposed Derwood Bible Church project.  Mayor Oland responded that the Town itself was unable to conduct such studies.

 

 

Council Member Frank Bennett made the motion to adjourn the meeting.  Council Member David Halperin seconded.  Meeting adjourned at 8:30 p.m.
