Meeting minutes of Town Council Meeting on January 4, 2005

As reviewed, approved, and accepted by the Town Council on February 1, 2005

 

 

 

Mayor Oland called the Public Hearing to consider a Preliminary Plan of Subdivision submitted by Laytonsville Communities LLC (Fulks South) to order at 7:30 p.m.

 

Mayor Oland introduced James Ruff, Macris, Hendricks & Glascock, P.A.  Mr. Ruff indicated that this preliminary plan was re-submitted to the Mayor and Council at their Work Session on December 14, 2004 and represents 121.80 acres of land with a total of 56 building lots.  The property will be serviced by public water and septic systems.

 

Mayor Oland requested Council testimony:

 

 

 

Dave Preusch                           Questioned trail system within the preliminary plan.  Mr.                                                         Ruff indicated that 6’ asphalt paths would be throughout

                                                the neighborhood.

 

 

Frank Bennett                           Questioned whether on the cul de sacs there would be side-

                                                walks on both sides.  Mr. Ruff indicated there would be in

                                                most cases.

 

Dave Preusch                           Stated that the land to the right of the water tower might be

                                                dedicated to the Town.  Mr. Ruff responded that right now

                                                the land will be dedicated to the Homeowners Association.

                                               

                                                Requested the consideration of creating variances for

                                                Septic systems on adjoining lots.  Mayor

                                                Oland responded it would not be appropriate to pursue the

                                                discussion of a variance.

 

 

 

 

 

 

 

Mayor Oland requested public testimony:

 

 

 

Sheree Wenger                         Questioned lighting on the pedestrian path.  It will be

6715 Maple Knoll Road            provided where appropriate.

Mayor Oland canvassed the Council as to the need for an additional Work Session to

Discuss the preliminary plan as submitted by Laytonsville Communities, LLC.  It was

Agreed by consensus that no further Work Sessions were needed.

 

Mayor Oland closed the Public Hearing at 7:40 p.m.  The Preliminary Plan of Subdivision submitted by Laytonsville Communities, LLC will be considered at the next regular Town Council meeting on February 1, 2005.

The regular meeting of the Mayor and Town Council   was called to order by Mayor Oland at 7:45 p.m.   The Mayor, Council Members Frank Bennett, David Preusch, Charles Bradsher and David Halperin were present.   The Clerk was present. The Treasurer was absent. There were 25 citizens present.

 

 

The minutes of the regular Town Council meeting of December 7, 2004 were approved as submitted with the correction that Council Member David Halperin seconded the motion to adjourn the December 7, 2004 meeting.

 

Treasurer’s Report:  Reviewing the Profit and Loss Report for the month of December, 2004, major sources of income were licenses in the amount of $716.00 and real property tax in the amount of $470.00.   Major expenses for December, 2004 were $2,074.00 for payroll, $840.00 for Town Hall repairs and maintenance and $2,375.00 for waste collection.  Looking at the Balance Sheet for the month of December, 2004, the fund balance for the general fund is $146,577.00; for the CIP account, the balance is $73,438.00; and the balance for the fixed assets fund is $380,361.  The total assets for the Town of Laytonsville for the month of December are $600,376.  Council Member Frank Bennett made the motion to accept the Treasurer’s Report as submitted, subject to audit.  Council Member David Halperin seconded the motion.  Unanimously approved.

 

Discussion/Action Items:

 

Charter:  Mayor Oland announced that the Mayor and Council have been working with the Institute of Governmental Services to revise the Charter for the Town. A public hearing will be held on February 1, 2005 to consider the revisions.

 

Preliminary Plan of Subdivision submitted by Laytonsville Communities, LLC:  No further comment

 

Annexation Agreement, Annexation Petition, Zoning of 27.36 acres located at 7215 Brink Road (Rolling Ridge):  Documents have been submitted by the petitioner and have been reviewed by Town Counsel, Stanley D. Abrams.

 

Town Hall Outbuildings:  Mayor Oland announced there will be a joint meeting on January 17, 2005 with the Mayor, Council and the Historic District Commission to discuss the status of the outbuildings.

 

Goshen Enterprises – Landscaping Maintenance Contract for 2005:  A contract similar in cost to 2004 has been submitted by Goshen Enterprises for the Landscaping Maintenance for the Town Hall and other designed Town locations.

 

 

Action Items:

 

Annexation Agreement, Annexation Petition, Zoning, Historic Resource Designation and authorization of signatory for approximately 27.36 acres located at 7215 Brink Road (Rolling Ridge):

 

Resolution Annexing to the Town 27.36 acres of land Known as the Jones Farm Property:  Council Member Dave Preusch made the motion to adopt the Resolution to Annex to the Town of Laytonsville, Maryland approximately 27.36 acres of land known as the Jones Farm Property (Rolling Ridge).  Council Member Frank Bennett seconded the motion.  Unanimously approved.

 

Resolution Authorizing the Mayor of the Town of Laytonsville to enter into an Agreement in Connection with the Annexation of approximately 27.36 acres of land known as the Jones Farm Property (Rolling Ridge):  Council Member Dave Preusch made the motion to adopt the Resolution Authorizing the Mayor of the Town of Laytonsville to Enter into an Agreement in Connection with the Annexation of Approximately 27.36 acres of land known as the Jones Farm Property.  Council Member Frank Bennett seconded.  Unanimously approved.

 

 

 

 

Ordinance to Establish Zoning of approximately 27.36 acres of land Known as the Jones Farm Property:  Council Member Frank Bennett made the motion to adopt the Ordinance to Establish Zoning of Approximately 27.36 acres of land Known as the Jones Farm Property.  Council Member David Halperin seconded.  Unanimously approved.

 

Resolution Designating Two Parcels of Land being part of the Property known as “Rolling Ridge” as an Historic Resource:  Council Member Frank Bennett made the motion to adopt the Resolution Designating Two Parcels of Land being part of the Property known as “Rolling Ridge” as an Historic Resource.  Council Member Dave Preusch seconded.  Unanimously approved.

 

Annexation Agreement:  Council Member Dave Preusch voted to adopt the Annexation Agreement submitted by Jones Farm LC and the Town of Laytonsville to annex approximately 27.36 acres of land located north of Brink Road and west of Laytonsville adjacent to the municipal boundary of Town into the corporate boundaries of the Town of Laytonsville.  Council Member Frank Bennett seconded.  Unanimously approved.

 

 

Mayor Oland reported that in light of the above approvals, a new Zoning Map and a new Land Use map reflecting the above approvals were received from Macris, Hendricks & Glascock.

 

New Land Use map reflecting Annexation of approximately 27.36 acres of land known as the Jones Property (Rolling Ridge):  Council Member Dave Preusch made the motion to adopt the Land Use Map for the Town of Laytonsville reflecting the Annexation of approximately 27.36 acres of land known as the Jones Property (Rolling Ridge) subject to the modification of the alignment of the proposed By-Pass.  Council Member Dave Halperin seconded.  Unanimously approved.

 

New Zoning Map reflecting the Annexation of approximately 27.36 acres of land known as the Jones Property (Rolling Ridge):  Council Member Frank Bennett made the motion to approve the new Zoning Map reflecting the Annexation of approximately 27.36 acres of land known as the Jones Property (Rolling Ridge) subject to the modification of the alignment of the property By-Pass.  Council Member Charles Bradsher seconded.  Unanimously approved.

 

 

Goshen Enterprises – Landscape Maintenance – 2005:  Council Member Dave Halperin made the motion to approve the proposal landscape maintenance contract received from Goshen Enterprises for the 2005.  Council Member Frank Bennett seconded.  Unanimously approved.

 

S. Montgomery Street Drainage:  Council Member Frank Bennett made the motion to approve the Storm Drain and Soil Erosion & Sediment Control Plan project as submitted by Macris, Hendricks and Glascock in the amount of $19,274.00.   Council Member Dave Halperin seconded.  Unanimously approved.

 

 

 

Council:

 

Council Member Dave Preusch questioned as to when Montgomery County Sanitation and Recycling would pick up Christmas trees for recycling on Thursday, January 13 and January 20.

 

Council Member Dave Preusch also reported that the Welcome Sign on the south entrance to the Town was leaning.

 

Citizens:

 

Resident Phyllis Sterling thanked the Mayor and Council and reported that the “No Stopping” signs had been installed by the State Highway Administration in front of Laytonsville Elementary School.

 

Mrs. Sterling also reported that a non-conforming sign was in front of the Laytonsville Volunteer Fire Department.

 

Council Member Frank Bennett made the motion to adjourn the meeting.  Council Member Dave Halperin seconded.  Meeting adjourned at 8:15 p.m.

 

A presentation was made by Pastor Steve Pettit and Associate Pastor Scott Chopas regarding the Derwood Bible Church and the Damascus Community Church’s proposed development of approximately 200 acres at Route 108 and Griffith Road.
