June 1, 2004

 

 

 

The regular meeting of the Laytonsville Town Council was called to order by Mayor Charles W. Oland on June 1, 2004 at 7:30p.m. in the Laytonsville Town Hall.  Council members Frank Bennett, Charles Bradsher, David Preusch and Tom Wilkinson were present.   Council Member-Elect David Halperin was present.  There were 10 citizens present.   The Clerk and Treasurer were also present. 

 

 

The minutes of the regular Town Council meeting of May 4, 2004 to include the minutes of the Public Hearing were approved as presented.

 

The minutes of the Work Session meeting of May 18, 2004 were approved as presented.

 

Discussion Items:

 

Treasurer’s Report:  The Treasurer reported that total income for the month of May, 2004 was $2,958.64.    The total expenses for the month were $11,645.59.  Major expenses for the month of May were legal fees: $3,876.00; grounds maintenance: $1,380.31; payroll: $896.27; special projects: $1,600.00 (Walkable Communities, Inc.) and waste collection: $2,375.40.  The balance in the  General Fund for the month of May is $96,247.81; the balance in the CIP fund is $79,316.28; the balance in the Fixed Asset account is $392,208.63; with a total asset balance of $567,772.72.   Council Member Tom Wilkinson made the motion to accept the Treasurer’s report as submitted, subject to audit.  Council Member Frank Bennett seconded.  Motion approved.

 

Treasurer Wilkinson also reported that she and Mayor Oland had met with Lindsey and Associates regarding auditing changes in the reporting of assets in relationship to roads/sidewalks due to GASB 34 regulations.

 

Discussion/Action Item:

 

Proposed Annexation: Elm Street Development (Rolling Ridge) Property:  Mayor Oland reported that the Petition for Annexation, the Ordinance to Rezone the Property, the Resolution to Annex the Property and the Outline of  the Extension of Services were being introduced at tonight’s meeting.  The schedule will be:  Publication of Notice of Public Hearing will appear in the Gaithersburg Gazette on June 9, June 16, June 23 and June 30, 2004.  Public Hearing scheduled for July 6, 2004 at 7:30 p.m. at the Town Hall, 21607 Laytonsville Road.  The Annexation Agreement is not subject to a Public Hearing and will be introduced after the Public Hearing.  The Mayor and Council can, therefore, act on the proposed annexation at the July 6, 2004 regular Town Council meeting if there is no adverse comment from the Public Hearing.

 

 

Discussion Items:

 

 

Mayor:

 

Town Hall Roof:  Jack’s Roofing cleaned and repainted portions of the roof.  Jack’s Roofing reported that the roof was not in good repair and should be replaced.  Mayor Oland recommended that an independent inspector review the condition of the roof within the next several years.

 

State Highway Administration:  After the Walkable Communities tour was completed, it is now appropriate to contact the SHA and try to implement traffic calming devices.  It was agreed by consensus that Mayor Oland contact the State Highway Administration.

 

Open House:  The Open House at the Town Hall on May 15, 2004 was a great success and attended by many residents and visitors.  The display honoring the 50th anniversary of the Laytonsville District Volunteer Fire Department received many compliments.  The Town is grateful to resident Phyllis Sterling for her efforts in creating this event.

 

Walkable Communities:  Eric Wenger reported that on May 8, 2004, Mr. Dan Burden, Walkable Communities, Inc. conducted a tour and review of the Town.  There was a fair participation of residents and citizens.  Mr. Burden presented some very good ideas : create wider roadway stripes; create a friendly walking space; create pedestrian crossings; create traffic circles at Brink/Sundown and Warfield and Route 108; improve sidewalks.  Many of Mr. Burden’s ideas are cost effective and could be easily implemented.  Mayor Oland thanked the Wenger family for their efforts in coordinating this event and preparing the flyer; the Prasher family for transportation; and the Wilkinson family for transportation, meals and lodging.

 

Water Service:  Mayor Oland reported that since the last regular Town Council meeting, that the developer in the Fulks South property has agreed to fund the deficit to supply water.  The budget was approved by Montgomery County Council with a straw vote.

 

Work Session for June 15, 2004:  The Work Session for June 15, 2004 has been canceled.  

 

 

Action Items: 

 

 

Correct Real Estate Tax Rate:  At the April meeting, the tax rate was approved at $.016 per hundred.  The correct amount is $.160 per hundred.  Council Member Frank Bennett made the motion that the minutes of the regular Town Council meeting of April 6, 2004 be changed to reflect the correct real estate property tax rate of $.160 per hundred for the 2004-2005 budget year. Council Member David Preusch seconded.  Motion approved.

 

 

Council:

 

Council Member David Preusch noted that Montgomery County did additional paving on Sundown Road.  There are now ruts on First and Second Streets and Mobley Farm Drive.  Mayor Oland to contact Montgomery County to determine the intent of this project.

 

Citizens:

 

Mayor Oland acknowledged Council Member Tom Wilkinson for his many years of service to the Town of Laytonsville.  Mr. Wilkinson was elected in July, 1994.

 

 

Council Member Frank Bennett made the motion to adjourn the meeting at 8:00 p.m.  Council Member Tom Wilkinson seconded.  Motion approved.  Meeting adjourned.
