The regular meeting of the Laytonsville Town Council was called to order by Mayor Charles T. White on October 1, 2002 at 7:30 p.m. in the Laytonsville Town Hall. Council members Bennett, Bradsher, Preusch and Wilkinson were also in attendance. There were fourteen citizens present. The Clerk and Treasurer were also present.

The minutes of September 3, 2002 were approved as read.

Special Exception Renewal - Laytonsville Volunteer Fire Department: Mr. Thomas P. Twigg provided an update on the renovations to the LVFD monopole; the addition of another antenna; and the reinforcement of the existing monopole.   The reinforcement work is 95% complete. The HVAC renovations at the LVFD are two-thirds complete and will be finished by the end of October. The temporary trailer behind the Fire House will be removed October 2, 2002. Mr. Twigg further reported that Crown Castle has agreed to install a fence between the LVFD and the residence next door.

 


Reports:

Treasurer:


A Budget Comparison Report was distributed. The Town is within budget on ail items with the exception of the Town sign. The Profit & Loss Statement was reviewed for the expenses through September, 2002. The C.I.P Fund Report was reviewed and reflected a balance of $80,000.

The Mayor reported on several items of benefit to the Town.

The Mayor also reported that a proposal in the amount of $1,039.1 Ihas been received to install two mercury vapor 16' 4' x 4' light poles. Councilman Wilkinson moved to table the request until council members have reviewed the site. Councilman Frank Bennett seconded the motion to table the request to install the light poles in the parking lot of the Town Hall. Motion approved.


Council:


Councilman Wilkinson reported that there were approximately $30,000 in funds available to the Town through the Maryland Park & Planning Program (Open Space). The Town would have to prepare a proposal to present to Maryland Park & Planning.   Councilman Wilkinson would like to invite townspeople to participate in his committee to pursue these funds.

Councilman Wilkinson reported that the "Welcome to Laytonsville" signs had been installed.

Councilman Wilkinson provided an update on the rental of the Town Hall. Refundable deposits and fees were discussed for the rental of the Town Hall.

Councilman Preusch recommended that steps be taken to maintain the Town Hall outbuildings from further disrepair. Councilman Frank Bennett recommended that the Mayor and Council members tour the outbuildings. The Mayor and Council will, therefore, tour the outbuildings on the Town Hall property on Saturday, October 5, 2002 at 9:00 a.m.

Councilman Bennett reported that a new proposal from the F. O. Day Company, Inc. had been received in the amount of $20,354. Councilman Bennett and made the motion to accept the F.O. Day proposal to repave a portion of Sunset Street for the proposed bid amount of $20,354.00. Councilman Wilkinson seconded the motion. Motion approved.

Councilman Preusch reported that the pine trees along Warfield Road in the rear of the shopping center do not provide an attractive entrance to the town. Councilman Preusch will write a letter to the shopping center owner.

Councilman Preusch reported that the dip in Mobley Farm Drive caused by poor compaction should be addressed.   Councilman Preusch made the motion to repair the dip in the Road on Mobley Farm Drive near Sundown Road. Mayor White seconded the motion. Councilman Bennett and Councilman Wilkinson abstained. Motion approved.

Councilman Wilkinson discussed the proposed east/west Route 108 Bypass. Councilman Wilkinson will call Maryland Park & Planning to make them aware that the Town of Laytonsville has an original plan reflecting a western bypass. Councilman Bennett made a motion to pursue the Route 108 Bypass within the Town's limits on the west side. Councilman Wilkinson seconded. Mayor White abstained. Motion approved.

Two fire extinguishers were installed at the Town Hall on September 24, 2002.

The Fire Inspector for Montgomery County Fire and Rescue Service visited the Town Hall on

September 23, 2002 and will make recommendations.

Seventy-three letters were sent out regarding the October 9, 2002 Reclassification Hearing to be

held for the Laytonsville Nurseries, Inc. and Laytonsville Properties request. The meeting will be

held at Laytonsville Elementary School in the Ail-Purpose Room at 7:30 p.m. The required notices

and signage were posted.                     •*.:                            :-

Dorothy Techter requested that the map donated by the Techter Family to the Town Hall be placed on another wall within the Town Hall.

Dorothy Tessier recommended that a public discussion be held regarding the proposed Route 108 Bypass.

Willard Oland made several recommendations/inquiries:

It was reported in the August 7, 2002 Gazette that the Town Hall was available for use by

Town organizations for meetings

In the August, 2001 copy of the Town Minutes, it was reported that Councilman David

Preusch was sworn in by the Clerk

Cold patch repair should also be applied to: front of Atco, front of the service station and

Mobley Farm and Route 108

Regarding the Open Space availability of funds:   the Town should develop a plan

delineating how much a park improvement would cost and what the final application

would be

Maryland Code can be obtained on-line regarding Executive Sessions conducted by the

Town

It was noted that in the motion passed for Mobley Farm Drive repair at tonight's meeting

of the Mayor and Council, there were not sufficient funds in the budget to complete the repair after the Sunset Street paving was completed

Phyllis Sterling reported that a street light was out on the first pole at the intersection of Route 108 and Brink Road.

The public is invited to join the Mayor and Council at their tour of the Town outbuildings and grounds on Saturday, October 5, 2002 at 9:00 a.m.

Unfinished Business:

The Washington Suburban Sanitary Commission reported that in response to the letter issued by the Mayor dated August 29, 2002 requesting further response to the WSSC's request for level of interest to provide water service to the Town of Laytonsville generated a good response. An additional twenty positive responses (for a total of 60); twenty-four declined the service and one was undecided.

New Business:               A snow removal contract for the Town of Laytonsville has been received from J.B. Kline

P.O. Box 5132, Laytonsville, MD to provide all labor, materials and equipment required to perform the snow plowing services for the Town as follows:

1.        Plowing services - $90.00 per hour for snowfall 2"-6"

2.            Spreading - $90.00 per hour

3.        Materials - $95.00 per ton

Councilman Preusch made a motion to accept the J.B. Kline proposal to provide snow plowing services for the Town for the 2002-2003 season. Councilman Bennett seconded the motion. Motion approved.

The meeting was then adjourned at 9:00 p.m. on a motion by Councilman Bennett. Motion was seconded and carried unanimously.
