LAYTONSVILLE BOARD OF APPEALS MEETING MINUTES

October 5, 2009 - 7:32 p.m.

Roll Call:

A meeting of the Laytonsville Board of Appeals was called to order by the Chair, Jake Cecere, at 7:30 p.m. Board Members Hewitt and Sladki were present. Members Pomeroy and Stadler as well as Alternate Member Whittington were not present..

Ms. Wenger and Mayor Oland were present. Minutes

Chair Cecere submitted the minutes for the meeting of September 14, 2009, and requested that his name in paragraph 6 and the word residence on page 2 be corrected. He also asked if there were any additions or corrections. Member Sladki proposed the motion to accept the minutes which was seconded by Member Hewitt. The motion was passed unanimously and the minutes approved with the recorded changes.

Old Business

Chair Cecere indicated that based on a review of Section 118-E and provided Mayor Oland a position letter indicating that the Board of Appeals was not in favor of Special Exceptions being transferred from property owner to new property owner.

Mr. Ruspi suggested that the Board of Appeals should review the process involved regarding the rejection of applications and the number of times an application can be changed and resubmitted was forwarded to the Town's Legal Counsel, Mr. S. Abrams.

None.

There being no further business, motion to adjourn made by Chair Cecere and passed unanimously. The meeting adjourned at approximately 7:45 p.m.
