LAYTONSVILLE BOARD OF APPEALS
MEETING MINUTES
April 7, 2008 - 7:30 p.m.
Roll Call:
The regular meeting of the Laytonsville Board of Appeals was called to order by the Chair, Jake Cecere, at 7:35 p.m. Board Members Ruspi, and Sladki, were present.
Attendance:
The meeting was attended by the following guests: Ms. Ruspi, Ms. Wenger, Ms. Sterling, and Mr. Benning.
Minutes:
Chair Cecere asked if there were any corrections or additions to the minutes of the March 3, 2008. Board Member Ruspi indicated that the word "previous" needed to be dropped from the minutes. A motion to accept the minutes of the March 3, 2008, meeting was made by Board Member Sladki and seconded by Board Member Ruspi. The minutes were unanimously approved as presented with noted correction. Mr. Ruspi requested that he receive an electronic version of the corrected minutes.
New Business
Stanley Abrams, Town Counsel, sent a memorandum to be reviewed by the Board of Appeals providing a process and procedures relevant for public hearings on special exceptions. Board Member Ruspi suggested that the documents be forwarded to the Board Members to allow them to review the material and comment at the next meeting scheduled for May 5, 2008.
Mr. Stan Benning, serving as Laytonsville Town Planner for the last 10-12 years, encouraged the Board Members to review the package which Mr. Abrams forwarded to the Board including the Board of Appeals, Rules of Procedure, for the City of Gaithersburg. It was felt that these guidelines could be amended in order to conform to Laytonsville 's master plan and zoning ordinances. Chair Cecere indicated that the Board of Appeals currently had procedures and guidelines available to applicants but that they were not as detailed as those submitted by Mr. Abrams.
Old Business:
DCPJ Holdings, LLC, requested that their application be postponed to the June meeting in order for the applicant to address several requests for information communicated to them by the Town's Planner, Mr. Stan Benning, and another consultant. A motion was presented to grant the request of the applicant to postpone the application and hearing for the property located at 6835 Olney-Laytonsville Road, Laytonsville, MD, to the June 2, 2008, meeting of the Board of Appeals. The motion was second by Board Member Sladki, and unanimously approved by all Members. All Members agreed that the 60 days' decision process would begin after the application and hearing were addressed in June.
